By downloading or using Lava Dash, you agree to these terms, to the safety agreement shown when the app first opens, and to Apple's Standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula).
Lava Dash is a physical game. Players walk, run, jump and climb onto furniture. You play at your own risk. Clear the space before you start, keep away from stairs, glass, hard edges and anything that could tip, and make sure an adult supervises children at all times. Stop playing if anyone feels unwell.
Remove Ads is an optional one time purchase billed through your Apple Account. It is not a subscription and does not renew. It turns off ads in Lava Dash on every device signed in to the same Apple Account, and can be restored from Settings, Restore Purchase. Refunds are handled by Apple.
LAVA DASH IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
To the maximum extent permitted by law, ThrasherApps is not liable for any injury, property damage, or indirect, incidental or consequential damages arising from playing Lava Dash or using the app.
To the maximum extent permitted by law, total aggregate liability arising from or relating to the app shall not exceed the greater of the amount you paid for the app and its in app purchases in the twelve months preceding the claim, or fifty United States dollars. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
You agree to indemnify and hold harmless ThrasherApps from any claim, liability, damage, loss or expense, including reasonable legal fees, arising from your use of the app or your breach of these terms.
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Any dispute shall be brought exclusively in the state or federal courts located in Georgia, and you consent to that jurisdiction.
These terms are linked from the App Store listing, from Settings in the app, and from the Remove Ads screen. They are in addition to Apple’s Standard Licensed Application End User License Agreement, which also applies. Apple is not a party to these terms.
These terms may be updated; the date above reflects the latest revision. Continued use after changes means you accept the revised terms.
